Charges refiled against two men in kidnappingMarch 12, 2009EAST COUNTY COURTS: Torture charges were refiled yesterday against two men accused of kidnapping a 76-year-old Mount Helix woman and holding her captive in her car for 26 hours. New charges of conspiracy to commit murder also were added against Jeffrey Nelson, 19, and Luis Osborne, 18, in connection with the Dec. 18 abduction and beating of Natalie "Sandy" Herbst-Vinge, Deputy District Attorney Paul Greenwood said. Also refiled were an attempted murder charge against Nelson and charges of robbery and financial abuse of an elder against Osborne, Greenwood said. Nelson and Osborne pleaded not guilty to all charges, and their lawyers said outside court that they will challenge the refiled and new charges in a May 1 hearing set by El Cajon Superior Court Judge Herbert J. Exarhos. A different judge, Lantz Lewis, dismissed attempted murder charges against Nelson and Osborne in February because he said there was no evidence that they took steps to kill Herbst-Vinge. Lewis also dismissed all charges against Antoinette Baker, a woman previously arrested in connection with the kidnapping. Herbst-Vinge was bound and gagged with duct tape and kidnapped in her 2006 Dodge Magnum from her home on Resmar Place about 10 p.m. Dec. 8, witnesses testified at the hearing in February.
